Legal Ramifications in the Use of Social Media

The presentation will cover the legal consequences of relying on social media in conducting background checks and checking the reputation of prospective employees.  It will include a discussion of relevant laws and court decisions regarding the consequences of the use of social media in making employment decisions.  The presentation will also include a discussion of how courts approach workplace harassment, discrimination, invasion of privacy and other civil rights issues involved in an employer’s discipline of employees for the use of social media as well as the employer’s ability to monitor employees’ use of social media in the work place and other electronic media, such email, the internet, employer-issued cell phones and lap tops.  The presentation will also include information regarding how to create and apply social media policies within the work place, including a discussion of important policy provisions, the importance of consistent application of policies and information on how to best inform employees of proper or improper use of social media in and out of the workplace.  The presentation will be interactive in that I will solicit real-life examples and questions throughout the presentation.  I will provide a written outline of information covered for distribution to attendees and will lead the discussion with a power point presentation containing key points and important concepts.
